- Introduction
These Terms and Conditions govern your access to and use of the Website and any purchases made through it.
By accessing the Website or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree with any provision of these Terms, you should discontinue use of the Website and its services.
These Terms apply to all visitors, customers, users, and others who access or use the Website.
- Definitions
For the purposes of these Terms and Conditions:
Noodle Beachwear, Noodle, we, us, or our refers to Noodle Beachwear, a brand owned and operated by Slim Tree S.r.l.
Website refers to www.noodle-shop.it and any related domains operated by Noodle Beachwear.
Products refer to all swimwear, beachwear, apparel, accessories, and other items offered for sale through the Website.
Order means a request submitted by a Customer to purchase Products.
Customer, you, or your refers to any person accessing the Website or purchasing Products through the Website.
- Eligibility
By using the Website and placing an Order, you represent that you are at least 18 years old and legally capable of entering into binding agreements.
- Pre-Contractual Information
In accordance with Italian Legislative Decree No. 70/2003 and the Italian Consumer Code (D.Lgs. 206/2005), Noodle Beachwear provides the following information before the conclusion of any contract:
(a) Identity of the seller: Noodle Beachwear is a brand owned and operated by Slim Tree S.r.l., reachable at info@slimtree.it.
(b) Products: Detailed descriptions, images, available sizes, colours, and key product information are provided on each product page. Noodle Beachwear makes every effort to ensure that photographs and descriptions accurately represent the Products; however, slight variations in colour, texture, or appearance may occur due to screen settings, lighting, or production characteristics.
(c) Prices: All prices displayed on the Website are expressed in Euro (EUR) and are inclusive of VAT where applicable. Any additional delivery costs will be clearly indicated before the Order is confirmed.
(d) Payment methods: Accepted payment methods are displayed at checkout. Payment is processed securely at the time of Order confirmation through third-party payment providers.
(e) Delivery: Estimated delivery times and available shipping options are indicated at checkout and may vary depending on the destination country and selected shipping method.
(f) Order process: The contract between Noodle Beachwear and the Customer is concluded when the Customer receives an Order confirmation email from Noodle Beachwear following successful payment.
- Orders and Availability
All Orders are subject to Product availability.
After an Order has been placed, the Customer will receive an Order confirmation by email. Noodle Beachwear reserves the right to refuse or cancel any Order at its sole discretion, including but not limited to cases of Product unavailability, suspected fraud, unauthorised or unlawful activity, pricing errors, system errors, or inaccuracies in Product information.
If a Product becomes unavailable after an Order has been placed, Noodle Beachwear will notify the Customer and issue a full refund using the original payment method.
- Prices and Payment
All prices are displayed in Euro (EUR) and are inclusive of applicable VAT.
Noodle Beachwear reserves the right to modify prices at any time. However, the price applied to a confirmed Order will not be altered after confirmation, except in the case of obvious pricing errors.
In the event of a pricing error on the Website, Noodle Beachwear reserves the right to cancel the Order and issue a full refund, notifying the Customer accordingly.
Payment must be completed at the time the Order is placed. All payment transactions are processed through secure third-party payment providers.
For deliveries outside the European Union, customs duties, import taxes, local charges, or additional fees may apply and remain the responsibility of the Customer, unless otherwise stated at checkout.
- Shipping and Delivery
Delivery times and shipping costs are indicated at checkout and may vary depending on the destination country and selected shipping method.
Noodle Beachwear will make reasonable efforts to fulfil Orders within the timeframe stated at the time of purchase, subject to Product availability.
Noodle Beachwear is not responsible for delays caused by third-party carriers, customs procedures, force majeure events, or circumstances beyond its reasonable control.
Risk of loss or damage to the Products passes to the Customer when the Customer, or a third party appointed by the Customer other than the carrier, takes physical possession of the Products.
- Right of Withdrawal
In accordance with Article 52 of the Italian Consumer Code (D.Lgs. 206/2005), Customers located within the European Union have the right to withdraw from the purchase contract without providing any reason within 14 (fourteen) days of receiving the Products.
To exercise the right of withdrawal, the Customer must notify Noodle Beachwear within the above period by completing the returns form available on the Website or by following the return instructions provided by Noodle Beachwear.
Following notification of withdrawal, the Customer must return the Products without undue delay and in any event within 14 (fourteen) days.
Products should be returned in the same condition in which they were received, unworn and unwashed, together with any original tags and packaging where reasonably possible.
The Customer may be liable for any diminished value of the Products resulting from handling other than what is necessary to establish their nature, characteristics, and fit.
Refunds will be processed using the same payment method used for the original transaction, unless otherwise agreed. Noodle Beachwear may withhold the refund until the returned Products have been received or until the Customer has provided proof of return shipment.
Return shipping costs are the responsibility of the Customer, unless the Product is defective or the return is due to an error by Noodle Beachwear.
The right of withdrawal does not apply to Products that have been made to the Customer’s specifications or are clearly personalised, where permitted by applicable law.

- Legal Guarantee of Conformity
All Products sold through the Website are covered by the legal guarantee of conformity provided under Articles 128–135 of the Italian Consumer Code (D.Lgs. 206/2005), as amended, and, where applicable, by Directive (EU) 2019/771.
In the event that a Product is defective or non-conforming, the Customer is entitled to request the remedies provided by applicable law, including repair, replacement, a price reduction, or termination of the contract, where applicable.
The legal guarantee lasts 2 (two) years from delivery of the Product, in accordance with applicable law.

- Product Information
Noodle Beachwear strives to ensure that all Product descriptions, images, measurements, colours, materials, and specifications displayed on the Website are accurate and complete.
However, Noodle Beachwear cannot guarantee that the Customer’s device display will accurately reflect the actual colour, texture, or appearance of the Products.
Minor variations between images and delivered Products, where not affecting the essential characteristics or conformity of the Products, shall not constitute a defect.
- Intellectual Property
All content available on the Website, including but not limited to photographs, product images, graphics, illustrations, logos, trademarks, designs, videos, text, original Noodle prints, artwork, creative assets, and other materials, is the exclusive property of Noodle Beachwear, Slim Tree S.r.l., or its licensors and is protected by applicable intellectual property laws.
No content may be copied, reproduced, distributed, modified, published, transmitted, displayed, sold, licensed, or otherwise exploited without the prior written consent of Noodle Beachwear.
The Noodle Beachwear name, logo, product designs, prints, and visual identity may not be used in connection with any product or service without prior written authorisation.
- User Conduct
You agree not to:
Use the Website for unlawful purposes;
Interfere with the operation, security, or functionality of the Website;
Attempt to gain unauthorised access to any part of the Website or related systems;
Use automated tools or scraping methods to extract data or content from the Website without prior written authorisation;
Use the Website in any manner that could damage, disable, overburden, or impair its operation.
- Third-Party Links
The Website may contain links to third-party websites or services.
Noodle Beachwear does not control and is not responsible for the content, policies, practices, or availability of any third-party websites or services.
Accessing third-party websites is entirely at the Customer’s own risk.
- Privacy and Data Protection
Noodle Beachwear processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Italian privacy legislation.
The collection, use, storage, and protection of personal data are governed by the Privacy Policy and Cookie Policy published on the Website.
By placing an Order, the Customer acknowledges having read and understood the Privacy Policy.
Customers retain the right to access, rectify, erase, restrict, and port their personal data, as well as the right to object to processing, in accordance with applicable law.

- Product Safety
All Products offered for sale through the Website are subject to applicable product safety requirements under Regulation (EU) 2023/988, also known as the General Product Safety Regulation (GPSR), applicable from 13 December 2024.
Noodle Beachwear takes appropriate measures to ensure that Products offered through the Website comply with applicable product safety requirements.
Any safety-relevant information is provided on Product labels and, where applicable, on individual Product pages.
In the event that Noodle Beachwear becomes aware of a safety issue concerning any Product, affected Customers will be notified promptly with the relevant instructions.

- Force Majeure
Noodle Beachwear shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control.
Such events include, but are not limited to, natural disasters, acts of government, strikes, labour disputes, transport disruptions, customs delays, pandemics, power failures, interruptions of communication networks, technical failures, or other force majeure events.
- Limitation of Liability
To the maximum extent permitted by applicable law, Noodle Beachwear shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Website or the purchase of Products, including but not limited to loss of profits, data, or goodwill.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, wilful misconduct, gross negligence, or any other liability that cannot be excluded or limited by law.
For consumer Customers, nothing in these Terms shall affect the mandatory rights granted under applicable consumer protection laws.
- Governing Law and Jurisdiction
These Terms and Conditions are governed by Italian law.
If the Customer is a consumer residing in another European Union Member State, the Customer will also benefit from any mandatory provisions of the laws of their country of residence.
For contracts concluded with Consumers, as defined under the Italian Consumer Code, any disputes shall be subject to the jurisdiction of the court of the Consumer’s place of residence or domicile, in accordance with applicable consumer protection laws.
For contracts concluded with non-consumer Customers or commercial parties, the Courts of Rome, Italy, shall have exclusive jurisdiction.
The European Commission’s Online Dispute Resolution platform was discontinued as of 20 July 2025, following Regulation (EU) 2024/3228.

- Amendments to These Terms
Noodle Beachwear reserves the right to amend these Terms and Conditions at any time.
Changes will be effective upon publication on the Website.
Customers are encouraged to review these Terms periodically.
Continued use of the Website following the publication of updated Terms constitutes acceptance of such changes.
